Welcome to BreathEZs®. These Terms and Conditions ("Terms") govern your use of breathezs.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. Please read them carefully.
BreathEZs® ("BreathEZs", "we", "us", or "our") is a premium apparel brand offering 100% cotton boxer briefs with an engineered airflow design. You can reach us anytime at customerservice@breathezs.com.
You must be at least 18 years old, or the age of majority where you live, to make a purchase. By placing an order you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.
Our first release is a limited run. We do our best to describe our products and display prices accurately, but we do not guarantee that product descriptions, colors, or other content are error free. All prices are listed in U.S. dollars and may change at any time before you place an order. We may limit quantities, correct pricing errors, and decline or cancel any order at our discretion, including after an order has been submitted. If we cancel an order you have paid for, we will refund you in full.
When you place an order you make an offer to buy, which we accept when we confirm the order. Many items in our first release are sold as preorders. Preorders are governed by our Preorder Policy, which explains estimated shipping timing, how delays are handled, and your right to cancel for a refund before your order ships. Shipping and returns are governed by our Shipping Policy and Return & Refund Policy.
Payments are processed securely by our third party payment provider. We never see or store your full card details. You authorize us, or our provider on our behalf, to charge your chosen payment method for the total shown at checkout, including any taxes and shipping.
The BreathEZs and BEZ names, logos, the diamond emblem, product designs, text, graphics, and all other content on the Site are owned by BreathEZs or our licensors and are protected by law. You may not copy, reproduce, distribute, or create derivative works from any of it without our written permission.
You agree not to misuse the Site, including by attempting to interfere with its normal operation, accessing it through automated means without permission, or using it for any unlawful purpose.
The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law, BreathEZs will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
These Terms are governed by the laws of the United States and the state in which BreathEZs operates, without regard to conflict of law principles. Any dispute will be resolved in the courts located in that state.
We may update these Terms from time to time. Changes take effect when posted on this page, and the "last updated" date will reflect the most recent version. Your continued use of the Site after changes are posted means you accept them.
